- Agency
CHECK-IN! Zimmerservice (from now on referred to as the “Agency”) is solely an agent acting between a private Host/Landlord (from now on referred to as the “Host”) and the Guest/Tennant (from now on referred to as the “Guest”). The Agency itself does not provide any accommodation or accommodation services. The booking therefore only gives rise to an agency contract between the Guest and the Agency, and for which the statutory regulations for travel agreements (Reisevertrag) (§§ 651 a.ff. BGB) do not apply.
- Booking
The details of every booking will be passed on by the Agency, on behalf of the Guest, to the Host concerned. The booking is only binding after the Guest receives the booking confirmation from the Agency. The Guest will receive the address and telephone number of the Host together with the booking papers via an email from the Agency. The Guest should then contact the Host as soon as practicable to inform the host of his/her approximate arrival time as well as any special requests for breakfast (assuming that a breakfast service is available). Breakfast can usually be provided by the Host (but should be arranged beforehand with the Host) and will be billed for separately (usually around €5 per person per day).
- Communication
Communications between the Guest and the Agency can be in written or electronic format (email). All declarations of intent are binding notwithstanding the chosen format.
- Billing and Settlement for Booked Services
A rental agreement will be produced between the Host and Guest as soon as the Guest has instructed the Agent to procure the accommodation. An invoice is issued by the Agency for the total cost (rent, plus Agency commission fee and German VAT) in accordance with the details shown for the accommodation on our Check-In! Zimmerservice website (from now on referred to as our “Website”) The amount of rent contained in the total invoice amount will be collected by the Agency from the Guest on behalf of and in the name of the Host. The invoice will usually be paid in two parts, the first payment (= Agency commission fee, see 5. below) will be paid to the Agency by the Guest directly after booking and in accordance with our time periods. The balance will be paid directly by the Guest to the Host (in cash on arrival or by bank transfer to the Host’s bank account). By special arrangement, between the Guest and the Host, this payment may be made to the Agency on an agreed date. In this case, the rental element will be transferred by the Agency directly to the Host. If the arrival date is within 10 days from the date of booking, a bank transfer confirmation must be provided. In the case of very short notice bookings, the Agency may request full invoice payment to the Host in cash upon arrival.
- Agency Commission Fees
The Agency charges the Guest a commission fee including German VAT for the services provided which is already included in the total price shown on the Website (the individual commission fee for a booking can be obtained from the agency upon request). The Agency is entitled to the commission fee after an online booking has been made and after the booking has been confirmed. Subsequent to the receipt of the invoice and payment instructions, the commission fee becomes due. The Agency’s services shall be deemed to be have been completed after a booking has been confirmed.
- Cancellation by the Agency
Should the Guest fail to pay the first installment or the agreed total the Agency reserves the right to cancel the booking and reserves the right to do so in writing. Article 3 applies. The Agency will normally cancel a booking in the case of a non-payment after a first reminder. The right of the Agency to claim the commission fee in full remains unaffected if a booking is cancelled due to non payment.
- Cancellation by the Guest
The Agency’s right to claim the commission fee in full remains unaffected should the Guest after having made the booking cancel such booking or simply not show on the arrival date (Article 5, last sentence applies).
The Host is entitled to the full amount of the agreed rent if the Guest is a no-show or if the Guest cancels within a short notice period, i.e. within 8 days of the agreed arrival date. If the Guest cancels the booking more than eight but less than 31 days prior to the agreed arrival date the Host shall be entitled to 60% of the agreed rent. Cancellations made prior to 31 days before the agreed arrival date incur no charges to the Host. The Host shall enforce all such claims directly against the Guest.
- Responsibilities to Agency
The Guest is not entitled to make direct bookings with the Host thereby bypassing the Agency. If a Guest attempts to do so the Host shall immediately inform the Agency. This applies also in the case of an extension of a stay.
- Warranties
The online description of the accommodation has been provided by the Host or has been checked by the Host after the Agency has entered the respective accommodation description into its Website. The Agency has verified the descriptions to the best of its knowledge but accepts no responsibility whatsoever for the actual condition of the accommodation offered by the Host. In addition the Agency shall not be liable for the Host’s readiness to fulfil their contractual obligations.
